How should faculty and staff respond to law enforcement requests for access to nonpublic areas and/or for student information?

The university's standing guidance on ICE covers access to nonpublic campus spaces and handling requests for student information that is protected by law, including FERPA.

In response to questions from faculty and staff, including those who manage or work at entry points to nonpublic spaces, optional quick reference cards are available for areas or individuals who find them helpful. Optional “Private Area” signage is also available for office areas, residential access points, or other nonpublic spaces (as described in the standing guidance). Use of these materials is voluntary. There is no change in policy.

You can download PDF versions of the Law Enforcement Guidance Cards and Private Access Sign for on-campus use. Printed copies will soon be available at The MOSAIC Center in Pigott Pavilion 180.

Will SU send a notification to students, faculty and staff if ICE or CBP is on campus?

快猫视频’s Department of Public Safety (DPS) issues 快猫视频UAlert emergency notifications to the campus community. 快猫视频 students, staff and faculty are automatically enrolled in 快猫视频UAlert emergency notification messaging. Under SU’s published procedures (see SU’s Annual Security and Fire Safety Report, p. 118), DPS sends 快猫视频UAlerts upon confirmation of a serious and ongoing threat to the health or safety of students and employees on campus.

Because federal law enforcement, including Immigration and Customs Enforcement (ICE) or Customs and Border Protection (CBP), could be present on campus for a range of activities that are not emergencies and do not pose a serious or ongoing threat, DPS will not automatically issue a 快猫视频UAlert based on their presence alone. If, however, DPS concludes that ICE or CBP’s activity presents a serious and ongoing threat, DPS will issue a 快猫视频UAlert to notify our campus community. This case-by-case process is the same approach DPS applies to the 快猫视频 Police Department (SPD), the 快猫视频 Fire Department (SFD) or any other agency activity near campus.

What are private spaces and public spaces?

Private Spaces: Nonpublic areas of a university building. For example, a residence hall or apartment rooms, classrooms, or faculty offices.

Public Spaces: Areas open to the general public. For example, the upper and lower mall, lobbies and hallways of building, the Quad, University Green, and 快猫视频 Park.

快猫视频’s posted guidance regarding Immigration and Customs Enforcement (ICE) refers to support for non-citizen students. Does this same guidance support non-citizen faculty and staff?

Yes. SU’s guidance regarding ICE supports all non-citizen faculty, staff, and students. The only student-specific item in the guidance relates to FERPA-protected student education records. But the same privacy principles would apply to ICE requests for faculty and staff records: Faculty or staff who receive a request from ICE for any information about an SU faculty or staff member should contact University Counsel at 206-296-2043.
